Terms of Service

By creating an account, paying for a subscription, or using the ChannelWhisper service, you agree to these Terms, our Privacy Policy, and any other legal notices published by us. If you do not agree to all of these Terms, do not access or use the service.

If you are using the service on behalf of an organisation, you agree to these Terms on behalf of that organisation and represent that you have the authority to bind that organisation to these Terms.

ChannelWhisper provides B2B SaaS tools to analyze competitor YouTube channels, monitor public video details, identify topic gaps, and generate video briefs. We reserve the right to modify, suspend, or discontinue any feature or part of the service at any time with or without notice to you.

Certain parts of the service require a paid subscription. Pricing, quotas, and tier details are listed on our Pricing page.

• Paddle Merchant of Record: Our order process and subscription billing are conducted by Paddle.com. Paddle is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
• Billing cycle: Subscriptions are billed in advance on a recurring monthly or annual basis, depending on your plan. Your subscription will renew automatically unless cancelled.
• Cancellation: You can cancel your subscription at any time through your dashboard customer portal. Cancellation takes effect at the end of your current billing period.
• Refunds: Except as required by local consumer law, all paid subscriptions are non-refundable. Please evaluate the tool during your free trial period.

You agree not to misuse the service. Specifically, you must not:

• Use the service to scrape, crawl, or download YouTube content in violation of YouTube's Terms of Service.
• Attempt to bypass quotas, limits, or plan controls set in the service.
• Submit false or misleading competitor channel URLs.
• Interfere with or disrupt the servers, databases, or networks connected to our service.
• Use automated scripts or bots to access or interact with the platform without our written consent.

• Your Content & Briefs: You own all intellectual property rights to the content briefs, outlines, and scripts generated by ChannelWhisper for you. We claim no ownership over your output.
• Our Platform: We own all right, title, and interest in and to ChannelWhisper, including the software, designs, logos, database schema, metrics, and algorithms. You may not copy, reverse-engineer, or distribute any part of our platform.
• Competitor Data: Channel statistics, video titles, and transcripts fetched from YouTube are publicly available information. ChannelWhisper does not claim ownership of competitor data.

The service is provided “as is” and “as available”, without warranty of any kind, express or implied.

We do not warrant that the service will be uninterrupted, error-free, secure, or that the AI-generated briefs, titles, and estimations will be completely accurate or generate specific revenue outcomes for your business.

To the maximum extent permitted by law, ChannelWhisper shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill resulting from your use of or inability to use the service.

In no event shall our total aggregate liability for all claims related to the service exceed the total amount paid by you to us in the twelve (12) months preceding the claim.

We reserve the right to suspend or terminate your account and access to the service at any time, with or without cause, for any violation of these Terms. Upon termination, your right to use the service ceases immediately, and we may delete your stored data in accordance with our Privacy Policy.

These Terms and your relationship with ChannelWhisper shall be governed by and construed in accordance with the laws of the jurisdiction in which our business is incorporated, without regard to its conflict of law principles.

We may revise these Terms from time to time. The most current version will always be posted here. We will notify you of any material changes via email or dashboard notification at least 14 days before they take effect. By continuing to use the service after revisions become effective, you agree to be bound by the updated Terms.
